General Terms and Conditions (AGB)

  1. Scope

These General Terms and Conditions apply to all orders made through our online shop and are only intended for consumers.

Consumer means any natural person who enters into a legal transaction for purposes that cannot be predominantly attributed to their commercial or self-employed professional activity. An entrepreneur means a natural or legal person or a legally capable partnership that acts in the course of a legal transaction in the exercise of their commercial or self-employed professional activity.

  1. Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with Healthy Teeth Operations GmbH.

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding online catalog. You can first place our products in the shopping cart without obligation and correct your entries before submitting your binding order by using the correction aids provided for this purpose in the ordering process and explained. By clicking on the order button, you make a binding offer for the goods contained in the shopping cart. The confirmation of receipt of your order will be sent to you by email immediately after submitting the order.

We accept your offer within two days by:

  • issuing an acceptance declaration in a separate email or
  • delivering the goods or
  • if necessary, the payment transaction is carried out by our service provider or the selected payment service provider. The execution time of the payment transaction depends on the selected payment method (see “Payment”).

The relevant alternative for you depends on which of the listed events occurs first.

We store the contract text and send you the order data and our AGB in text form. You can view the contract text in our customer login.

  1. Delivery conditions

We deliver free of shipping costs.

We only deliver by mail. Self-pickup of the goods is unfortunately not possible.

We do not deliver to parcel stations.

  1. Payment

The following payment methods are generally available in our shop:

Advance payment

If you choose advance payment, we will provide you with our bank details in a separate email and deliver the goods after payment has been received.

Credit card

In the order process, you provide your credit card details. Your card will be charged immediately after the order is placed.

SEPA direct debit procedure

By placing the order, you give us a SEPA direct debit mandate. We will inform you at least one banking day in advance about the date of account debiting (so-called pre-notification). A banking day is any working day except for Saturdays, nationwide statutory holidays, and December 24th and 31st of each year. The account debiting takes place before shipment of the goods.

PayPal, PayPal Express

In order to pay the invoice amount through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after the order is placed. Further instructions will be received in the ordering process.

PayPal Plus

In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie,

S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), we offer the following payment options as PayPal services. Unless otherwise regulated, payment via PayPal Plus does not require registration with PayPal. Further instructions will be received with the respective payment option and in the ordering process.

In order to pay the invoice amount through the PayPal payment option, you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after the order is placed.

Credit card through PayPal

Your card will be charged by PayPal after shipment of the goods.

Direct debit through PayPal

Payment by direct debit via PayPal requires an address and credit check and takes place directly with PayPal. By confirming the payment instruction, you give PayPal a direct debit mandate. You will be informed by PayPal about the date of account debiting (so-called pre-notification). The account debiting takes place before shipment of the goods.

Google Pay

In order to pay the invoice amount through the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have the Google Pay function activated, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be carried out immediately after the order is placed. Further instructions will be received in the ordering process.

Apple Pay

To pay the invoice amount through payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have the Apple Pay feature enabled, authenticate with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after the order is placed. Further information will be provided during the ordering process.

giropay/paydirekt

In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt am Main (“giropay” or “paydirekt”), we offer the payment methods giropay and paydirekt.

To be able to pay the invoice amount via giropay, you must have a bank account activated for online banking, authenticate accordingly, and confirm the payment instruction. Your account will be charged immediately after the order is placed. Further information will be provided during the ordering process.

To be able to pay the invoice amount via paydirekt, you must have a bank account activated for online banking, be registered with paydirekt, authenticate with your login credentials, and confirm the payment instruction. Amazon Pay

To be able to pay the invoice amount through the payment service provider Amazon Payments Europe S.C.A., 38 Avenue J.F. Kennedy, L-1855 Luxembourg (“Amazon”), you must be registered with Amazon, authenticate with your login credentials, and confirm the payment instruction. The payment transaction will be carried out within one business day after the order is placed. A business day is any weekday excluding Saturdays, national legal holidays, and December 24th and 31st of each year. Further information will be provided during the ordering process.

  1. Transportation damages

If goods are delivered with obvious transportation damages, please report such errors to the delivery person as soon as possible and please contact us immediately. The failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurer.

The statutory defect liability applies.

  1. Liability

We are always liable for claims due to damages caused by us, our legal representatives or agents,

  • in case of injury to life, body or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of guarantee promises, if agreed, or
  • to the extent that the scope of the Product Liability Act is opened.

In case of breach of essential contractual obligations, whose

fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations) by slight

negligence on our part, our legal representatives or

agents, the liability is limited in amount to the foreseeable damage at the time of conclusion of the contract, with the occurrence of which is typically expected.

In addition,

claims for damages are excluded.

  1. Dispute Resolution

The European Commission provides an online dispute resolution platform (ODR), which you can find here. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
